¶1 Appellant, Derrick Davis, appeals from the judgment of sentence entered in the Court of Common Pleas of Philadelphia County following his convictions of possession of a controlled substance, possession of a controlled substance with intent to manufacture or deliver, possession of drug paraphernalia and criminal conspiracy. On appeal, appellant challenges whether trial counsel was ineffective for failing to litigate his motion to suppress and whether the evidence was sufficient to sustain his conviction for possession of a controlled substance. For the reasons that follow, we reverse and remand for a new trial.
